Construction begins with due diligence and a strong contract that lays the foundation for the project.  This provides the protection you need by anticipating and minimizing risk.  Bakal Law PLLC understands what it takes to negotiate and draft construction contracts that aim to share risk fairly.

When there is a dispute between an owner and a contractor or a contractor and a subcontractor, one party may be required to make a written claim to the other party to be resolved in negotiations, mediation, arbitration or litigation.  These disputes can be made for any number of reasons, including faulty documentation, construction defects or delays, unforeseen conditions, violations and damage to adjacent properties.  Unfortunately, if a claim is not made in a timely manner, it can be waived and further action may not be able to be brought, even if it is obvious who is at fault.  Construction claims can completely halt a project, costing countless hours and up to millions of dollars.

Sometimes plans change on a construction project.  When an owner changes his or her mind or the scope of work is altered, it is critical that parties fill out and sign a change order that reflects the changes to protect all parties involved. When disputes arise, a court or arbitrator may look to this contemporaneous documentation in order to assess the situation and grant any adjustments in the contract amount and time for completion.  You may also have to file a mechanic's lien or claim upon a payment bond to get paid.  Filing and discharging mechanic's liens properly can be a complex process that requires attention to detail and a strong legal knowledge of filing deadlines and legal procedure.  We have that experience and knowledge.
